Lockyer said he has heard complaints over the years that justice has not been done in family law courts in Marin. "They were substantive and serious, and it seemed to me they needed to be addressed," Lockyer said.

  Having won his bid for re-election, Judge Sutro now is attempting to end the free speech of Pulitzer Prize winner Dave Mitchell. This is not a case of, "Only in Marin." A good number of Marinites tried. However judicial politics and the Marin Independent being the kissin' cousins they are; unbiased coverage simply doesn't exist.

But a word of caution about Judge Sutro's court is certainly in order. We suggest one enter naked. We make this suggestion not because of any prurient interest on our part; but the odds are in keeping with Judge Sutro's namesake past. You'll be taking a bath.

Commissioner Harvey Goldfine
Goldfine is the go-to guy when a defendant pleading out to a sex crime wants a crime lite sentence. Goldfined can be counted on for a theatrical tongue lashing; and then letting the guys walk. Just ask Stan Savage, and Anna Melillo; parents of a daughter who was sexually assaulted. The assailants were wrist slapped by Goldfine and released in a plea deal Goldfine signed off on.

What's up with family court and cozy issues that never seem to get addressed? We're not sure. While we appreciate Judge Boren requested an audit and investigation of court contracts; it's another demondtration of, too little too late. Plus, Boren doesn't have a good history of protecting kids.

Derek Davis, son of a long time Public Defender, Mark Davis was originally charged with six crimes which carried a maximum 11-year prison sentence upon conviction, including sexual battery by restraint and two counts of lewd and lascivious acts upon a minor.
Judge Boren allowed Davis to accept a plea, then refused to adopt several recommended sentencing terms, although, to the surprise of no one, the probation report did not specify a jail sentence, as is customary in Marin.
None of Derek Joseph Davis' victims were at his sentencing hearing, but one had written the court expressing concerns about the "close-knit legal community" in Marin and the possibility that Davis might get special treatment because his father is a veteran Marin deputy public defender.
Davis, 21, was sentenced to four months in jail after previously accepting a plea deal that reduced his crimes from felonies to misdemeanors.

That Judge Sutro remains on the bench is a clear demonstration the 'watch dog press" doesn't exist.
